How to Calculate Lost Wages After a Workplace Accident

Sometimes workplace accidents result in serious injury leaving a worker incapable of working for a long period of time. When there is a dispute between the employee and employer regarding negligence, employees need to secure guidance from a personal injury attorney in an effort to recover damages for their lost wages. Determining the amount of lost wages can be difficult for most individuals and can depend on several factors.

Some factors to consider when determining lost wages include whether the employee received any compensation from the employer immediately following the accident. For example, if the employer paid the worker while he or she was out and did not deduct any time from the employee’s sick bank, the employee would not have any lost wages despite enduring a work place injury.

If an employer refused to pay an injured worker immediately following an injury requiring the worker to take time off, then the employee and their attorney need to determine the amount of money lost. Workers who receive hourly pay and salaried employees are sometimes at an advantage when determining lost wages when compared to workers whose pay is largely dependent upon sales and commission.

Most individuals are not able to determine the amount of their lost wages, despite their pay structure, without the assistance of a lawyer who specializes in employment litigation. In addition to lost wages, lawyers can sometimes recover punitive damages if foul play was present and can even address issues related to seniority. For example, if an employee was off work for a year, it might affect their retirement eligibility.

Workplace injuries can be tragic. Sustaining an injury is bad enough, but when the injury has financial implications, then the tragedy is amplified. If you’ve been injured in a workplace accident, the attorneys at The Lucaj Law Firm, PLLC are ready to fight to get you the compensation you deserve.
