Steps to Take After a Workplace Accident

Workplace accidents and injuries can occur in any profession, and employers have a legal responsibility to protect their employees while they are at work.  If you have recently been injured at work, the first thing you need to do is report your injuries to your employer.  All employers (except for very small companies) must keep an accident book. This is mainly for the employee’s benefit, as it provides a useful record of the incident.  It also gives your employer a documented account of what factors are causing accidents to occur, which can help them take the necessary steps to prevent the same accident from occurring in the future.

After you report your injury, your employer will recommend that you see a doctor who is authorized by the company.  It should be noted that if you seek medical attention from a personal doctor, you will be responsible for all of the medical expenses.  However, there are limited cases where employees can visit a doctor of their choice upon approval by the employer’s insurance company.

In the aftermath of your accident, make sure you do the following:

  • Inform the doctor that your injuries were caused while you were at work.  This will ensure that the doctor fills out and sends the correct forms to the insurance company.  These forms explain both the injuries and treatment you received.
  • Wait for the insurance company to communicate with you about the report.  Once the insurance company contacts you, there will be some additional forms to complete.  These forms will expedite your treatment and return to work.  Your claim will either be compensated or denied by the insurance company.

If your claim is accepted, you will receive benefits for temporary disability. If your claim is denied, then you have the right to appeal.

If you’ve been in a workplace accident and your insurance claim has been denied, it is important that you enlist the services of a skilled and experienced personal injury attorney.  The attorneys at the Lucaj Law Firm specialize in all aspects of personal injury cases, and we are committed to helping you receive the compensation you deserve.  Contact us today for a free consultation.
