What Happens If My Child Is Found Guilty of Drinking Underage?

Finding out that your child has been found guilty of underage drinking is certainly not a comforting scenario. The implications it may have for their future as well as their present circumstances are enough to send any parent's head spinning. If your child has been found guilty of drinking underage, here's what you need to know:

In Michigan, as with every state, it is against the law for any person under the age of 21 to possess or consume alcohol. An individual under the age of 21 may be found guilty if they are caught possessing alcohol or if a Preliminary Breath Test (PBT) reveals that there is any alcohol in their system - though it should be noted that someone under suspicion of drinking underage does not have to submit to a PBT and is generally recommended not to do so.

Penalties for drinking underage in Michigan vary depending on whether it is a first-time offense as well as other factors. In most cases, though, the penalties amount to a fine, probation, and/or community service.

If your child has been charged with underage drinking, know that there are a number of ways to fight this charge, lessen the penalty it carries, and keep it from going on your child's record. Should you ever find yourself in this situation, we recommend you contact the team at The Lucaj Law Firm as soon as possible so we may begin constructing an effective defense.
