When Should You Sue After a Slip and Fall Accident?

While you were shopping at the local grocery store, you have probably heard, “Clean up on aisle 6!” Or in the cold winters, you were walking on the sidewalk to get to your friend’s house and all of a sudden the ground beneath your feet is now next to your head. You slipped on the cold, hard ground whether from juice that spilled in the grocery store or the ice that was never properly salted. Slip and fall accidents are considered personal injury cases and whenever an accident occurs and you are injured due to the poorly maintained ground, you could be entitled to damages.  

To determine when you should sue your accident to receive damages, Michigan allows you to file a claim within three years from the date of your accident against the party at fault. You can file the claim at any time within the statue of limitations. However, before you file a claim, you will want to retain a personal injury attorney to attempt to negotiate a settlement with the owner of the property. Sometimes you will negotiate with their insurance company depending on your slip and fall situation. If you cannot come to an agreement, then you will need to sue the owner or insurance company.  

Once you decided to file a lawsuit, if the damages you are seeking are more than $25,000 then you will file in the Circuit Court; otherwise, you will file a claim for less than $25,000 in the District Court. If your claim is even less than $3,000, then your lawsuit will be filed in the Michigan Small Claims Court. The way to determine the amount of your lawsuit is through the costs incurred from your injury. This can include your medicals bills, future-earning ability lost, lost wages during recovery for the injury, attendant care, emotional distress and more.
